Anarchy and Tyranny in Idaho’s Homeowner Associations: Why we need new common interest property ownership legislation

Idaho has little legislation governing common interest property ownership associations. As a result, more disputes must be resolved in the courtroom than necessary. The Idaho Supreme Court’s recent Beaver Springs opinion highlights some of the disadvantages of this court-based approach.

A summary of practical law and legal advice for board members of common interest ownership associations in Idaho. This Guide collects relevant law relating to condominiums, homeowner associations, and nonprofit corporations, and presents it to a non-lawyer audience.

Idaho Transfer Fee Ban

Discusses transfer legislation proposed (and ultimately passed into law) in Idaho. Homeowner associations are not the intended target of these types of laws, but they can be included by broad language banning deed-based transfer fees.
